Absence of Restraint Devices

Child safety seats are required for very young children in all 50 states. The age varies, but typically children that are 2 years old and under must be restrained in a safety seat that meets certain federal standards. Some state laws require children of a certain age (between 2 and 6, for example) to be secured by at least a safety belt. A violation is a misdemeanor offense that may include a possible jail sentence.

TIP: Age is not the only indicator for deciding if a child must be restrained. Most laws list a height minimum for a child, regardless of age, which requires a safety seat.

Seatbelt laws vary by state. Generally, the driver and all minor passengers in the front seat are required to wear a seatbelt.

TIP: Some state laws exclude drivers and passengers from seatbelt laws who can provide a medical reason for not wearing one.
